These Terms of Service apply to your use of www.chrystyscreations.com and www.chrystyscreationsshop.com, including our custom design tools, and purchases made directly through our websites. “We,” “us,” and “our” mean Chrysty’s Creations, LLC. Please review these terms before submitting an order.

Using Our Website

You must be of legal age to enter into a purchase agreement, or have a parent or guardian place the order. You agree to provide accurate information and use our website and design tools lawfully. Do not upload unlawful material, interfere with the website, introduce harmful code, or misuse another person’s information.

Made-to-Order Products

Our products are made to order and are not ready to ship unless a listing expressly states otherwise. Processing time varies according to the product and complexity of the order. Review the processing time on the relevant listing before purchasing.

Processing time is separate from shipping time. A faster shipping service does not reduce production time. Rush processing, when available, must be arranged through the applicable rush listing or confirmed with us. Please contact us before ordering if you have an event deadline.

Custom Designs and Customer Approvals

You are responsible for checking quantities, sizes, colors, spelling, dates, personalization, uploaded images, and design selections before submitting your order. Where a preview or approval is requested, review it carefully before confirming.

Please submit required files and information promptly. Missing files, unclear instructions, or requested changes may delay production. If an Etsy order uses our submission tools, the submitted size and quantity must match the purchased options. We will contact you about discrepancies before proceeding or cancelling the order.

We produce custom items using the files and instructions provided. Image quality depends on the original file, and printed colors may differ from screen colors. Handmade items may have reasonable variations in appearance. These variations do not excuse supplying an incorrect or defective product.

Permission to Use Uploaded Materials

You confirm that you have the rights or permission needed for us to reproduce the photos, artwork, logos, and other materials you submit, including permission relating to people shown in photos where required.

You retain your rights in your submitted materials. You give us permission to reproduce, crop, resize, print, store, and otherwise process them only as needed to prepare your product, fulfill the order, and provide related support. We may refuse material we reasonably believe is unlawful or infringes another person’s rights.

Submitting an image does not give us permission to publish it for promotion. Separate permission will be requested for promotional use.

Product Use and Care

Fondant toppers are intended for decorative purposes only and are not intended for consumption, even when made with food-grade ingredients. Follow the listing and care instructions for each product.

Remove any supports, wires, sticks, or other non-food components before serving. Keep small parts away from young children. For edible image products, review the product’s ingredient and allergen information and contact us before ordering if you have questions. Do not assume every product has the same ingredients or allergen status.

Prices, Payment, and Order Acceptance

Prices are shown in the currency displayed on the website. Applicable shipping charges and taxes are shown at checkout. Payment is required when placing an order unless we expressly agree otherwise.

We may decline or cancel an order because of suspected fraud, unavailable materials, an unresolved listing or pricing error, or an inability to fulfill the request. We will notify you and refund amounts paid for any order we cancel and do not fulfill. We will not substitute a materially different product or charge a higher price without your agreement.

Cancellations, Returns, and Order Problems

Because products are made to order, our standard policy is that orders cannot be cancelled after placement and we do not accept change-of-mind returns or exchanges. Please review your selections before purchasing.

This policy does not exclude refunds, replacements, cancellation rights, or other remedies required by applicable law, including where goods are defective, incorrect, or not supplied as agreed.

If your order arrives damaged or incorrect, contact us promptly, preferably within 24 hours of delivery, with your order number and clear photos of the items, packaging, and shipping label. Keep the items and packaging while the issue is reviewed. This requested reporting period does not limit statutory rights.

Shipping and Delivery

We ship to the address supplied at checkout. Please check it carefully and contact us immediately if a correction is needed. Address changes cannot always be made after shipment.

USPS Ground and USPS Priority Mail options may be available at checkout. Contact us before ordering if you need a faster service. Delivery estimates are separate from production time and are not guarantees. Purchasing an order for a particular event does not create a delivery guarantee unless we expressly confirm one.

Carrier delays may occur. A missed estimated delivery date alone does not automatically qualify for a refund under our standard policy. Contact us about delayed or missing packages so we can investigate and help with the appropriate carrier process. Nothing in these terms removes remedies required by law or transfers all responsibility for lost or damaged deliveries to the customer.

If we cannot ship within the timeframe agreed for your order, we will notify you and offer the options required by applicable law, including cancellation and a refund where required.

Our Website Content

Our original website text, photographs, branding, and designs are owned by us or used with permission. Do not copy, republish, or commercially exploit them without authorization, except where permitted by law. Third-party materials remain the property of their respective owners.

Privacy and Third-Party Services

Our handling of personal information is described in our Privacy Policy. Shopify powers our store, and third-party providers support payments, uploads, and other functions. Their services may also be subject to their own terms and privacy notices. This does not remove our responsibilities to you.

Purchases completed on Etsy remain subject to the listing and policies applicable to that Etsy transaction and Etsy’s terms. Using our website to submit images does not change those purchase terms.

Applicable Law and Updates

These terms are governed by Florida law, except where applicable law requires otherwise. Nothing in these terms limits mandatory consumer protections or remedies.

We may revise these terms by posting an updated version with a new date. Changes apply prospectively and do not retroactively change an existing order without your agreement or a legal requirement.
